Please read carefully.
**1. Acknowledgment of Risks:** I, the undersigned participant, acknowledge and understand that participating in fitness activities and exercises under the instruction of Kristen Smith or any instructor compensated by Kristen Smith or Miami Beach Boot Camp LLC, at various locations, involves inherent risks of physical injury, illness, and in extreme cases, death. These risks may arise from the environment, the equipment, actions of others, or through my own physical condition and actions.
**2. Assumption of Risk:** I voluntarily agree to assume all risks, both known and unknown, associated with these activities, even if arising from the negligence of the instructor, Kristen Smith, Miami Beach Boot Camp LLC, their agents, employees, or any other persons or entities acting on their behalf or under their name.
**3. Waiver and Release:** In consideration of being allowed to participate in the fitness activities, I hereby release, waive, and discharge Kristen Smith, Miami Beach Boot Camp LLC, its instructors, agents, employees, and any other persons or entities acting on their behalf or under their name (the "Releasees"), from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained by me while participating in these activities or while at any location where the activities are conducted, whether caused by the negligence of the Releasees or otherwise.
**4. Indemnification:** I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs, including court costs and attorney fees, that they may incur due to my participation in said activities, whether caused by negligence of Releasees or otherwise.
**5. Acknowledgment of Understanding:** I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.-
