BY “Playhouse Paradise LLC”
Playhouse Paradise LLC reserves the right to cancel or withdraw a registration of a group based on
improper
behavior and conduct of
child participant
and/or parent.
In consideration for allowing myself or child to participate in programs and other activities at or sponsored by Playhouse Paradise
LLC
and further in consideration of the Playhouse Paradise LLC allowing
me and/or my child to enter and use the facilities owned, leased or otherwise provided by the Playhouse Paradise LLC (the “Facilities”) undersigned, for myself and for my child and his/her parents, heirs, assigns, personal and legal representatives and estate, fully and completely releases, discharges and holds harmless Playhouse Paradise LLC, and its directors, trustees, staff, employees, agents, insurers, instructors, coaches, caregivers, business owners and volunteers (collectively “its agents and employees”) from any and all claims, actions, causes of action, and damages of any kind whatsoever, including but not limited to claims for personal injury or property damage, arising out of myself and/or my child’s participation in any program or activity at the playhouse paradise or its Facilities.
The undersigned acknowledges and recognizes there are inherent risks involved in certain activities or recreational activities at Playhouse Paradise LLC and the Facilities and the undersigned and myself or my child assumes the risk of any injury sustained while at Playhouse Paradise LLC or at its Facilities. The undersigned agrees to indemnify, defend and hold harmless Playhouse Paradise and its agents and employees from any and all claims arising out of my child’s participation in any program or activity at playhouse paradise or the Facilities, even if such claim arises as a result of a negligent act or omission of Playhouse Paradise or its agents and employees.
This Waiver and Release Agreement (“Agreement”) is made between Playhouse Paradise LLC, including its owners, employees, agents, and representatives (referred to as “the Company”), and the participant or the legal parent/guardian of the participant (collectively referred to as “Participant”).
1) Assumption of Risk: Participant understands that using the indoor playground and coffee shop involves risks of injury, illness, or damage to personal belongings. Participant willingly accepts all risks, whether known or unknown, related to using the Company’s facilities, even if these risks result from the Company’s negligence.
2) Release of Liability: Participant, on behalf of themselves and their heirs, assigns, personal representatives, and next of kin, releases and discharges Playhouse Paradise from any liability, claims, demands, actions, or causes of action related to any loss, damage, injury, or death that may occur while using the Company’s facilities.
3) Policies and Regulations: Participant agrees to follow all Company policies and regulations, which may change over time. Participant confirms they have read or had the chance to read the Company’s policies, including a no-shoe rule in the playground area.
4) Health and Safety Guidelines: Wellness Requirement: To ensure the health and safety of everyone, children who appear sick or show any signs of illness, including but not limited to COVID-19, cannot use the indoor playground. This includes symptoms like fever, cough, runny nose, skin rash, stomach problems, or any other signs of contagious illness. If a child seems unwell, the Company has the right to ask the child and their guardian to leave the area right away.
5) Other Provisions: a. This Agreement represents the complete understanding between the parties and replaces all previous discussions, understandings, and agreements. b. If any part of this Agreement is deemed invalid, the rest will still be effective. c. This Agreement will be governed by the laws of Michigan.
I, the undersigned, have read and understood this Waiver and Release Agreement, and I willingly sign it, intending to be legally bound.
