RELEASE FROM LIABILITY

I, [FIRST NAME][LAST NAME](Participant/Parent/Guardian name: Last, First, Middle), fully understand that participation in the Marina Dunes Preserve Planting Event (hereinafter "event/class") exposes  me to the risk of personal injury, death or property damage. I hereby acknowledge that I am voluntarily participating in this event/class and agree to assume any such risks. 

I and my child hereby waive, release, and discharge any and all claims for damages for death, personal injury, or property damage which I or my child may have, or which may hereafter accrue to me or my child, as a result of participation in the Monterey Peninsula Regional Park District program. 

I hereby release, discharge, indemnify, hold harmless and agree not to sue Monterey Peninsula Regional Park District for any injury, death or damage to or loss of personal property arising out of, or in connection with, my participation in the event/class from whatever cause, including the active or passive negligence of Monterey Peninsula Regional Park District, its member chapters and/or any of their agents, servants, employees, contract instructors, or any other participants in the event/class. 

It is further understood and agreed that this waiver, release and assumption of risk is to be binding on my heirs and assigns, and the heirs and assigns of my child. 

I agree to assume all responsibility for any property damage or injury to any person caused by me, or my child while participating in the Monterey Peninsula Regional Park District Programs. 

VIDEO-PHOTO RELEASE 
Photographs and/or the photographs of my child, including video photography, film photography, digital photography, or other reproduction of my likeness or the likeness of my child, may be used without charge by the producers, sponsors, organizers for subsequent flyers, brochures, presentations or educational material. 

RELEASE, HOLD HARMLESS AND AGREEMENT NOT TO SUE 
I HAVE CAREFULLY READ THIS RELEASE, HOLD HARMLESS AND AGREEMENT NOT TO SUE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT IT IS A FULL RELEASE OF ALL LIABILITY AND SIGN IT ON MY OWN FREE WILL. 

HSPMB WAIVER OF LIABILITY INDEMNIFICATION AND HOLD HARMLESS AGREEMENT  

1. I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE THE Habitat Stewardship Project Monterey Bay (HSPMB) PROGRAM, THE STATE OF CALIFORNIA, THE TRUSTEES OF THE CALIFORNIA STATE UNIVERSITY, UNIVERSITY CORPORATION AT MONTEREY BAY, AND THEIR OFFICERS AND EMPLOYEES (hereinafter collectively referred to as the “RELEASEES”) from any and all liabilities, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by minor, or to any property belonging to me or minor, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES, or otherwise, while participating in such activity, or while in, on or upon the premises where the activity is being conducted. 

2. I am fully aware of risks and hazards connected with the activity of and I hereby elect to voluntarily participate in said activity, and to enter the above-named premises and engage in such activity knowing that the activity may be hazardous to participant and my property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR AND RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by participant, or any loss or damage to property owned by me, as a result of being engaged in such an activity, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASES or otherwise. 

3. I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS the RELEASED from any loss, liability, damage or costs, including court costs and attorney’s fees, that they may incur due to participation in said activity, WHETHER CAUSED BY NEGLIGENCE OF RELEASES or otherwise. 

4. It is my express intent that this Release, and Hold Harmless Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE the above-named RELEASES. I hereby further agree that this Waiver and Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of California. IN SIGNING THIS RELEASE, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Waiver of Liability Indemnification and Hold Harmless Agreement, understand in and sign it voluntarily as my own free act of deed; no oral representations, statements, or inducement, apart from the foregoing written agreement, have been made. As parent/guardian, I certify that he/she is in excellent health and has no physical, mental or emotional problems that are likely to prevent participation in strenuous physical activity. I give permission for participant to be medically treated for illness occurring or injury sustained during such participation and certifies that he/she is covered by medical insurance.

Photo Release: I hereby grant Habitat Stewardship Project Monterey Bay (HSPMB) or the University Corporation at Monterey Bay permission to use my likeness in photograph(s) in any publication or publicity materials (including but not limited to books, newsletters, videos, and web use), in perpetuity. I will make no monetary or other claim against HSPMB or the city of Salinas for the use of the photograph(s).
