REGISTRATION & MARKETING WAIVER RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AND PARENTAL CONSENT AGREEMENT ("AGREEMENT") IN CONSIDERATION of being permitted to participate in any way in the WESTOSHA SPORTS COMPLEX (WSC) facility activities ("Activity") I, for myself for personal representatives, assigns, heirs, and next of kin: 1. ACKNOWLEDGE, agree, and represent that I understand the nature of such activities and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity. 2. FULLY UNDERSTAND THAT: (a) WESTOSHA SPORTS COMPLEX ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH ("RISKS"); (b) these Risks and dangers may be caused by my own actions or inaction’s, the actions or inaction’s of others participating in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE "RELEASEES" NAMED BELOW; (c) there may be OTHER RISK AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation or that of the minor in the Activity. 3. ASSUMPTION OF RISK, WAIVER AND RELEASE for COMMUNAL INFECTIOUS DISEASES (including but not limited to: COVID 19). That by signing below I fully understand that I am assuming any and all risk of contracting any Communal Infectious Disease while utilizing or visiting the facilities at WSC and am representing to WSC that I have taken all available precautions to stay disease free; furthermore, I acknowledge that even though WSC has put preventative measures in place that there is no way to fully prevent the spread of a Communal Infectious Disease when going out in public or to a facility such as WSC. I acknowledge that by patronizing WSC that I have put myself and my minor child(ren), VOLUNTARILY, at risk of exposure and contraction thereby I am assuming that risk myself. Furthermore, that I will save and hold WSC harmless for any and all liability whatsoever relating to the contraction and spread of any Communal Infectious Disease thereby waiving and releasing them from any LIABILITY, ILLNESSES, CLAIMS, DEMANDS, LOSSES OR DAMAGES and voluntarily waiving my right to sue WSC (OR its owners and employees directly) in any forum including but not limited to the following: County, State or Federal Court System. 4. HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE WESTOSHA SPORTS COMPLEX, their respective administrators, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owner and lessors of premises on which the Activity takes place, (each considered one of the "RELEASEES" herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the Releases, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim. I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT. MINOR RELEASE AND I, THE MINOR’S PARENT AND/OR LEGAL GUARDIAN, UNDERSTAND THE NATURE OF WESTOSHA SPORTS COMPLEX ACTIVITIES AND THE MINOR’S EXPERIENCE AND CAPABILITIES AND BELIEVE THE MINOR TO BE QUALIFIED, IN GOOD HEALTH, AND IN PROPER PHYSICAL CONDITION TO PARTICIPATE IN SUCH ACTIVITY. I HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS EACH OF THE RELEASEE’S FROM ALL LIABILITY CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON THE MINOR’S ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATION AND FURTHER AGREE THAT IF, DESPITE THIS RELEASE, I, THE MINOR, OR ANYONE ON THE MINOR’S BEHALF MAKES A CLAIM AGAINST ANY OF THE RELEASEES NAMED ABOVE, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS LIABILITY, DAMAGE, OR COST ANY MAY INCUR AS THE RESULT OF ANY SUCH CLAIM. CANCELLATION POLICY I also understand that WESTOSHA SPORTS COMPLEX does enforce a cancellation policy. You need to have at least 48 hours notification of cancellation to get a full refund on all YOUR SERVICES. If you do not give 48-hour notice, fees will be collected for these services at full rate. You will be refunded completely if given over 48-hour notice. PRIVACY POLICY WESTOSHA SPORTS COMPLEX which uses eSoft Planner for scheduling and taking payments, is committed to protecting your privacy and ensuring you have a positive experience on our website. This policy outlines our handling practices of personal information both online and offline data. If you give us personal information, we will treat it according to this policy. If you are not satisfied with our response to your privacy-related concerns, please contact us. We encourage you to read this privacy policy to ensure you understand eSoft Planner's privacy practices. This policy covers the eSoft Planner website and related software. MARKETING WAIVER I will not publish any negative comments on social media regarding any WSC Staff, team, player, coach, director, or other players in the complex. I agree that the use of cellphones is not allowed at the facility during any practice, tournament, or WSC sponsored event without the permission of WSC Staff. I agree to let Westosha Sports Complex use images of me on any form of media (digital or print). I agree to not use the "WSC" name or logo on clothing, print or media without the permission of a WSC owner.
