RELEASE, WAIVER OF LIABILITY AND INDEMNITY AGREEMENT
In consideration of being permitted to participate in an activity being held at 4920 Telegraph Avenue Suite H, in Oakland, California (the “Workshop”), I agree to the following:
- I acknowledge that if there is physical activity involved in the Workshop, then there is also some risk of physical injury. I agree to participate with full knowledge of these risks. Should I deem my participation in any of the activities to be unsafe, I will opt out of that particular process and not put myself in harm’s way. I further agree that it is my sole responsibility to make this judgment call, and not the responsibility of the Workshop facilitator(s) nor any of the other participants.
- I understand that participating in any indoor group activity, regardless of the safety protocols used, increases my risk of contracting diseases in general and COVID-19 in particular. Therefore, participation in the Workshop increases my risk of requiring medical treatment, suffering adverse, permanent side-effects, and death. It also increases my risk of passing COVID-19 to others, exposing them to harm and/or death. I agree to follow the instructions of the facilitator(s) of the Workshop regarding COVID-19 safety procedures and the Temple Dara COVID-19 Site Specific Protection Plan in order to protect myself and others. I further agree to participate in the Workshop with full knowledge of these risks to myself and others.
- I assume all risk from participating in the Workshop. I and my heirs and assignees shall fully indemnify, hold harmless, and defend Heather Munro Pierce Kelley, Temple Arts Institute LLC, and Temescal Spaces LLC, as well as their owners, members, partners, teachers, officers, agents, contractors and employees, from and against all claims, demands and causes of action, suits, damages, liabilities, settlements, now or in the future, whether or not involving a third-party claim, for any losses or physical, emotional or psychological illness or injury, however caused, arising from, occurring during or occurring after my participation in the Workshop.
- I further expressly agree that this release, waiver of liability and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the State of California, and if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
- I have read and voluntarily signed this document, and further agree that no oral representations, statements or inducements apart from the foregoing written agreement have been made.
This release and waiver of liability agreement is governed by the laws of the State of California, United States of America.
