Participation Waiver Form

Pure Athletex DBA Pure Turf / Pure Hoops Academy / PA Tennis Academy / The Gym At Pure Athletex WAIVER AND RELEASE OF LIABILITY
and or Parental Consent 

I , the undersigned acknowledge the inherent risks involved in tennis/baseball/softball/football/soccer/weight lifting/training or any other sporting event and all activities relating thereto. Accordingly, in consideration of being permitted to participate in any athletic activity and/or physical activities at Pure Athletex, I agree to the following: 

1. I acknowledge and fully understand that I or my child will be engaging in activities that involve risk of serious injury, which may include permanent disability and even death, and severe social and economic losses which might result not only from my actions, but also from the action, inaction, or negligence of others, the rules of play, or the condition of the premises, or any equipment used and further that there may be risks not known to me or not reasonably foreseeable. 
2. I agree that prior to participating in any activity at Pure Athletex, I will inspect the premises and all equipment to be used, and if, through any inspection, I determine that anything related to that activity is unsafe, I will immediately advise my coach or a Pure Athletex employee of this unsafe condition and will not participate until this condition is corrected. 
3. I agree to assume all the foregoing risks and accept personal responsibility for my own damages following such injury, permanent disability, or death. 
4. I release, waive, discharge, and covenant not to sue Pure Athletex and all their respective agents, affiliates, associates, officers, directors, owners, and employees (collectively “releases”) from demands, losses, or damages on account of any injury, death or damage to property, cause or alleged to be caused in whole or in part by releases or any other party’s actions, inactions, or otherwise; and agree to indemnify releases from any and all third party claims caused in whole or in part by my actions.
5. At times, Pure Athletex DBA Pure Turf / Pure Hoops Academy / PA Tennis Academy / The Gym At Pure Athletex holds training programs off site, away from the primary building. The signer of this waiver acknowledges that the contents of this document and the releasing of liablity for injury and or death follows the participant to the off-site location. 
6. I authorize Pure Athletex the right to take and make use of any and all pictures or video taken of me/my child participating in single or group athletic activities to be used with the strict use only in and/or for any lawful promotional materials including, but not limited to, newsletters, flyers, posters, brochures, advertisements, fundraising letters, annual reports, press kits, websites, social networking sites and other print and digital communications, without payment or any other consideration. The buisness is very mindful of the privacy and manner of which pictures can and should be used for marketing purposes only.  If you wish not to have you or your child included in any marketing/promotional content, please email David@pureathletex.com. 
7.  I give consent to have my personal information included in marketing information from the above mentioned businesses and can opt out of these marketing materials at any time by emailing David@pureathletex.com.  

I, the undersigned participant, parent or legal guardian have read the above waiver and release and agree to its terms on behalf myself and or my child. I understand that by signing below I am giving up substantial rights on behalf of myself and or my child/children.
