OREGON ADAPTIVE SPORTS EQUIPMENT AGREEMENT AND RELEASE
Please read the following release of liability and financial agreement for Oregon Adaptive Sports (OAS) equipment usage carefully before signing. By signing the following agreement, you acknowledge that you have read, understood, and agree to the text presented and further waive liability from OAS. The following is a guideline and is not intended to be a complete list. Please initial next to each statement indicating your agreement to abide by OAS’ equipment requirements.

GENERAL POLICIES AND GUIDELINES - I am responsible for following program policies and providing positive public representation. I understand that disregard for policies may result in the revocation of use privileges.

FINANCIAL RESPONSIBILITY - I accept full responsibility for OAS equipment while it is in my possession, and agree to pay for any equipment repairs and labor costs should equipment be returned damaged beyond normal wear and tear. I agree to replace equipment at retail cost, should equipment be lost or stolen while in my possession. I understand that I may be responsible for additional charges should equipment be returned dirty or late and that if I incur additional charges due to damages and fail to pay, I may be prohibited from participating in OAS activities until my account is in good standing.

EQUIPMENT INSTRUCTION AND CARE - OAS equipment is maintained regularly and checked before being checked out for use. I accept OAS equipment for use, as is and understand it is my responsibility to check equipment before each use. I am familiar with the proper use of the equipment and acknowledge that I will use the equipment safely and appropriately to it’s designed usage. I am aware that OAS staff are available should I need additional instruction on how to properly use the equipment, require a repair, or need an adjustment. I will not make any adjustments or perform maintenance on equipment other than emergency repairs and those approved by the equipment manager. I agree that it is my responsibility to contact OAS staff if I need more information on how to use equipment or request an adjustment. I acknowledge that OAS has the right to terminate my equipment use for any reason at any time.

FIT - I understand that equipment is specifically adjusted for my personal use and to accommodate the measurements I have given. I certify that I have provided OAS with correct information and have made no misrepresentation about my height, weight, age, and supplemental measurements. I agree to use the equipment for personal use only.

SAFETY EQUIPMENT - I agree to wear the appropriate safety gear at all times while using rental equipment. Helmets are required to be worn while using OAS cycling equipment. Type III personal floatation devices are required to be worn while using any water-related sports equipment. I agree to wear any additional safety gear that may be required based on the equipment rental as specified by OAS personal or manufacturer. I understand that wearing required safety gear is not a guarantee of my health and safety in all foreseeable circumstances.

USAGE/TRANSPORTATION - I agree to use OAS equipment in designated areas. I will never use OAS equipment under the influence of alcohol/ drugs. I will never use a cell phone while operating OAS equipment. I will follow the rules of the road and right of way when using cycling equipment. I acknowledge that I am not to transport cycling equipment in my own vehicle for my own safety and preservation of the equipment.
I agree to HOLD HARMLESS AND INDEMNIFY Oregon Adaptive Sports/Move United from all liability for personal injury, damage of property or death claimed by me or by a third party resulting from my use of OAS equipment. I accept full financial responsibility for all damages that occur to OAS equipment and for all medical expenses due to injury or death while using OAS equipment.
FOR PARTICIPANTS UNDER THE AGE OF 18 OR LEGALLY DEPENDANT
As a parent, legal guardian, or legal representative, I am signing on behalf of the minor or legal dependent who is participating in OAS’s Equipment Agreement. I accept full financial responsibility for all damages that occur to OAS equipment and for all medical expenses incurred as a result of this person’s use of OAS equipment. I agree to HOLD HARMLESS AND INDEMNIFY Oregon Adaptive Sports from any claims due to injury, damage to property, or death as a result of this person’s use of OAS equipment.
I HAVE CAREFULLY READ THIS AGREEMENT AND UNDERSTAND ITS CONTENTS. BY SIGNING BELOW, I HEREBY REPRESENT THAT I AM AT LEAST 18 YEARS OF AGE AND FULLY COMPETENT TO SIGN THIS AGREEMENT ON MY OWN BEHALF.
