LIBERTY HALL RELIC HUNT RELEASE FORM

This Waiver of Right to Sue and Assumption of all Risks Agreement ("this Agreement") is hereby given by the undersigned Participant to Liberty Hall Plantation LLC, as an activity sponsor, Daniel & Sarah Coleman as an owner of land upon which an activity to which the Agreement relates is conducted, as well as each partner, officer, agent, employee, director, shareholder, member heir, personal representative, successor and assign of the sponsor and of each owner, hereby referred to as “Sponsor”. In consideration for the opportunities provided by the Sponsor and each owner to the undersigned Participant (including any minor participants for whom he signs this Agreement) for the enjoyment of relic hunting activities as a participant, the undersigned Participant (including any minor participant for whom he/she signs this Agreement) hereby agrees as follows:
- The participant agrees to indemnify and hold harmless the Sponsors and their insurance carrier, and each of them from any loss, liability, damage or cost they may incur arising out of or related to the event whether caused by the negligence of the Sponsors or otherwise.
- The participant agrees that they are a Participant under the Equine Activity Liability Act (Code of Virginia 3.1- Participant.130 et seq.) and release and waive all rights against the Sponsor for death, personal injury or property damage which is in any way associated with the risks established under the Act. The participant hereby waives their right to sue or to bring any action against the sponsor in connection therewith. The participant agrees to indemnify and defend the sponsor and to hold the sponsor harmless against any such suit or action.
- The participant hereby expressly assumes all risks and dangers of death, personal injury and property damage which are in any way associated with falling, unstable conditions, equestrian activities, cattle, hazards of surface or subsurface conditions, interactions with sound, movements, objects, persons, animals, reptiles, birds or insects, and the effects of such reactions, weather conditions, foreseeable or unforeseeable hazards with rocks, cliffs, hills, fences, trees, stumps, logs, bridges, ditches and other debris and obstacles, and any activity in connection therewith, foreseeable or unforeseeable vehicle hazards, etc…
- The participant agrees that the hunt boundaries have be identified and a map has been provided, and if the participant crosses those boundaries onto an adjacent property, the participant may be subject to being cited by the adjacent property owner for trespass.
- The participant understands that no alcoholic beverages or firearms are allowed on the hunt property.
- The participant agrees to abide by the following rules established by the Liberty Hall property owners/caretakers and understand they will be asked to leave the property should they fail to follow them.
- Dutifully fill all holes and pack the dirt to the extent I can.
- Return all gates to the condition in which they were found when passing through them. If a gate is found open, it shall be left open, if closed, it shall be left closed. If there is any question, it should be closed.
- Remove or make available for removal all unwanted metal objects recovered.
- Complete an architectural data sheet for all items found. Data sheet to be provided date of the hunt
- Present all finds at the end of the day to the Liberty Hall staff and allow them to photograph the finds.
- Give to Liberty Hall any significant historical items or items related to Green family history for placement in the family collection.
