PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK
In consideration of the services of Gecko’s Island Adventures, their agents, owners, officers, volunteers, participants, employees and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as “GIA”), I hereby agree to release, indemnify, and discharge GIA on behalf of myself, my family, my heirs, assigns, personal repressive and estate as follows:
- I acknowledge that my participation in UTV activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property or to my children. I am aware this UTV adventure is a physically demanding outdoor activity. I understand and agree that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. Risks may include but not limited to; rough terrain; passengers may be jolted, jarred, bounced, thrown off and shaken during rides. I acknowledge I and other participants could be injured if I make contact with other passengers. I acknowledge that injuries can be sustained from the trail, equipment, or from items on the trail such as holes, bumps, ruts, rocks, tree limbs or other items. I acknowledge that exposure to the elements may cause injury and such environmental risks include the following but are not limited to heat, wind, rain, and sun exposure. I acknowledge the risks associated with the UTV adventure where accidents or illness can occur in remote places without medical facilities, or first responder pick up and my machine may fail and slips and falls are always a possibly in addition to weather or other environmental conditions are ever changing. - I expressly agree and promise to accept and assume all risks, known or unknown, typically associated with riding in a UTV in remote difficult terrain. Initial Here
- I certify that I have adequate insurance to cover any injury I suffer while participating, or else I agree to bear the costs of such injury myself. Initial Here
- I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless GIA from any and all claims, demands, or causes of action, including but not limited to attorney fees and court costs, which are in any way connected to my voluntary participation in this activity or use of any equipment or facilities, including any such claims which allege negligent acts or omissions of GIA. - If the guides feel that the participant’s safety is in question due to noncompliance of the rules, the tour will be concluded without refund. Initial Here
- If I am signing for a minor to be a passenger, I represent I have the legal capacity to sign on the minor’s behalf. Initial Here
- I represent that prior to engaging in the UTV adventure, I have not consumed any alcohol and drugs that will impair my judgment and reduce my ability to safely participate in the adventure activities. I agree that ALCOHOL and DRUGS OF ANY KIND that may or could impair my judgement will NOT be consumed either prior to or during my UTV adventure. I agree that GIA reserves the sole right to cancel my tour at any time if I show any signs of being under the influence. Initial Here
- I understand that if at any point I cannot continue the tour for any reason, I agree I will not get a refund and I will be responsible for the costs of transportation of myself and machine. Initial Here
- I am aware that tours are not cancelled for rainy or windy weather. Initial Here
- I am aware of the weight restrictions (1000lbs for all passengers combined) and agree to be weighed. If we exceed the weight limit, GIA will not be able to accommodate all booked guests on the tour. I understand that I will have the option of designating one or more guests who will not be able to participate and I acknowledge that those guests will lose their tour and will not receive a refund. - I understand that GIA may take photographic or other electronic images of my UTV adventure and I agree that all images obtained in any form are the property of GIA and they reserve the right to use these images for any commercial or business purpose. I agree to release and forever discharge GIA from any and all demands, actions, causes of actions, suits, damages, costs and any other claims that may arise regarding said images or their use. Having had ample time and opportunity to raise any concerns or questions that I may have, and having read and understood the information herein and the posted rules, I certify my agreement of the provisions by signing below. I am in good health and physical condition. I am voluntarily participating with knowledge of the dangers and risks involved. I have read and understood the agreement set out above and I agree to be bound by its terms.
