- “DPCS” means Donna’s Pet Care Services.
- “DPCS Personnel” means owner, employees, assistants, members, agents, sole proprietors, independent contractors, trainers, apprentices and any other people deemed to be providing services on behalf of DPCS.
- “facilities”, “dog park”, “off leash”, and “off lead” means any and all areas designated for use by the general public with their dogs or dogs in their care, by the municipality, province or region in which they are located.
- “Services” means the services by DPCS Personnel, including but not limited to “on leash/lead” dog walking, “off leash/lead” dog walking, dog park visitation and other dog social activities both with individual dogs as well as in groups
Declaration:
Dogs are animals and as such can be unpredictable and have the potential of displaying unwanted behaviours without warning. Working with dogs is not without risk to humans, other animals and material possessions. Dogs are living creatures and their behaviours can naturally change over time due to factors such as age, changes in diet, changes in their environment and the fact that dogs are animals and can be erratic and unpredictable, and as such DPCS does not provide any guarantees with respect to the Services provided by DPCS.
This waiver and release applies to all sales, services, and operations with respect to dog walking, and dog park visitations provided by DPCS and DPCS Personnel to the Client. All Services are being provided for personal use only to the Client and Client’s dogs and not for commercial use in any way.
The Client represents that they are the legal owner of the named dog that is requiring the Services herein, and the Client is aware that participation in any individual or group dog walking or dog park visitation may result in illness, accident, injury, and death to the dog. The Client agrees that they are aware of these risks and dangers and assume all responsibility for their dog as well as themselves and the Client shall remain responsible for their dogs at all times and are advised to ensure that they have adequate pet or household insurance coverage for liability in the unlikely event of damage or injury caused to their dog or caused by their dog to property or to a third party, including any other person, animal, object or anything whatsoever.
DPCS reserves the right to refuse to provide service to a Client or their dog at its own discretion.
This Release and Waiver must be executed by all parties who own the dog.
Safety
The safety of the dogs of all of our Clients as well as DPCS Personnel is of the utmost importance to DPCS. If a dog is deemed to be undisciplined, aggressive, or unresponsive, our Services will not be able to accommodate said dog. If your dog does not exhibit these traits during the initial consultation or use of the Services but begins exhibiting these characteristics at a later date, DPCS shall be entitled to terminate all Services to your dog effective immediately.
You as the Client are solely responsible for determining if your dog is physically fit and adequately skilled to go on leashed walks, “off-leash” walks, or visit dog parks while in the care of DPCS. If your dog is pregnant, disabled, or suffering from any illness, medical condition, injury or impairment, you are advised to consult with a veterinarian before undertaking any dog exercise activity and to disclose any such information to DCPS. Please advise us on consultation if your dog has never visited a dog park prior to them being in the care of DPCS as DPCS, in its sole discretion, may evaluate whether to bring your dog to a dog park.
In areas that are not designated as “off-leash” areas, dogs are legally required to be leashed at all times. DPCS will only take dogs off-leash in designated areas. DPCS will only take dogs off leashes in undesignated areas if specifically requested by the Client, provided, however the Client will assume all risks and responsibilities in taking dogs off a leash in non-designated areas while in the care of DPCS or DPCS Personnel. This includes all risks as outlined in this waiver and release as well as any additional risk associated with non-designated “off-leash” areas such as fines, injury, and the failure of the dog to respond to commands. Upon the initial consultation and dog boarding process, the Client is responsible for advising DPCS of their dog’s experience, abilities, and behaviour while “off-leash”.
Dog Parks
Dog parks are intended to provide a fun and rewarding environment and experience for dogs and their owners. Even with proper and careful preparation, instruction, medical advice, conditioning, and equipment, there is still a serious risk of injury to the dog, people, property, and other animals when “off-leash” and in an environment where there are numerous other factors. Dogs are unpredictable and even with proper training and care, will act instinctively and in unforeseeable ways. Despite the best efforts of DPCS and DPCS Personnel, it is impossible for DPCS to guarantee the safety of your dog while at a dog park or “off-leash” area or to guarantee the safety of any other person or object.
