Dog Boarding Agreement and Terms and Conditions
Please read the following carefully.
In this dog boarding agreement (the “Agreement”), the following terms have the corresponding meaning:
“Client”
“DPCS”
DPCS Personnel
- means any owner(s), caretaker(s), custodian(s) or any other person(s) who takes care of the dog.
- means Donna’s Pet Care Services.
- “meansowner, employees, assistants, members, agents, sole proprietors, independent contractors, trainers, apprentices and any other people deemed to be providing services on behalf of DPCS.
- “Facility(ies)” means any and all areas designated by DPCS for dog boarding with respect to the Services referenced herein.
- “Services” means the services by DPCS Personnel, including but not limited to dog boarding and dog sitting at a DPCS Facility.
These Terms and Conditions apply to all sales, Services, and operations provided by DPCS and DPCS Personnel and any other people deemed to be providing services on behalf of DPCS to the Client.
Declaration:
Dogs are animals and as such can be unpredictable and have the potential of displaying unwanted behaviours without warning. Working with dogs is not without risk to humans, other animals and material possessions. Dogs are living creatures and their behaviours can naturally change over time due to factors such as age, changes in diet, changes in their environment and the fact that dogs are animals and can be erratic and unpredictable, and as such DPCS does not provide any guarantees with respect to the Services provided by DPCS. These Terms and Conditions apply to all sales, Services, and operations provided by DPCS and DPCS Personnel and any other people deemed to be providing services on behalf of DPCS to the Client.
The Client represents that they are the legal owner of the named dog that is requiring the Services herein; the Client is aware that participation in the Services may result in illness, accident, injury, and death to the dog. The Client agrees that they are aware of these risks and dangers and assume all responsibility for their dog as well as themselves and the Client shall remain responsible for their dogs at all times and are advised to ensure that they have adequate pet or household insurance coverage for liability in the unlikely event of damage or injury caused to their dog or caused by their dog to property or to a third party, including any other person, animal, object or anything whatsoever.
DPCS reserves the right to refuse to provide service to a Client or their dog at its own discretion. This Agreement and Terms and Conditions must be executed by all parties who own the dog.
Safety
The safety of the dogs of all of our Clients as well as DPCS Personnel is of the utmost importance to DPCS. If a dog is deemed to be undisciplined, aggressive, or unresponsive, our Services will not be able to accommodate said dog. If your dog does not exhibit these traits during the initial consultation or use of the Services but begins exhibiting these characteristics at a later date, DPCS shall be entitled to terminate all Services to your dog effective immediately. You as the Client are solely responsible for determining if your dog is physically fit and has the proper temperament to participate in the Services while in the care of DPCS. If your dog is pregnant, disabled, or suffering from any illness, medical condition, injury or impairment, you are advised to consult with a veterinarian before participating in any and all Services and to disclose any such information to DCPS. Please advise us on consultation if your dog has never participated in dog boarding or the Services prior to them being in the care of DPCS as DPCS, in its sole discretion, may evaluate whether to accept your dog for the Services.
Payment and Refund Policy
Payment is required in full at the time of agreement to these terms and conditions and prior to the delivery of Services. No refunds will be provided for any Services provided after the Services have begun; additionally, no refunds will be provided for cancellation with less than 72 hours' notice as spots are held and cannot be replaced on short notice.
Terms and Conditions
- For the safety of your dog as well as all other dogs on the Premises, all dogs must be up to date with their vaccinations, worming, and tick and flea treatments. The client must provide DPCS with the vaccination booklet/records at the start of each board. Furthermore, all dogs must be delivered for boarding in a clean and groomed condition.
- In addition to all other mandatory vaccinations, the Client must provide proof that all dogs are vaccinated for rabies, distemper, and bordetella (also known as kennel cough). If upon arrival for boarding, any dog demonstrates any symptoms relating to the above mentioned conditions, said dog will be refused boarding. In the event that a Clients dog introduces any viruses or diseases, including but not limited to the above-mentioned conditions, into the Premises as a result of not having demonstrated symptoms at the initial inspection and drop-off and said symptoms have been confirmed after inspection by a veterinarian, the Client or Clients emergency contact shall be responsible for having said dog immediately removed from the Premises so as to not risk spreading the infection to other dogs on the Premises. In the event that the Client is not able to pick up the dog from the Premises immediately, said dog will be quarantined on the Premises at an extra cost to the Client until said time that a veterinarian determines that it is safe for the dog to be released from quarantine.
- The Client represents that their dog has not been exposed to or shown symptoms of rabies, distemper, bordetella, or any other contagious conditions within 30 days prior to their dog being provided with the Services by DPCS.
- In the event that another dog or DPCS Personnel is bitten or otherwise exposed to any disease or ailment received from the Clients dog which had not been properly vaccinated, the Client will be responsible for all costs and damages incurred by the victim and agrees to indemnify and hold harmless DPCS and DPCS Personnel.
- The Client confirms that their dog is non-aggressive. In the event that a dog begins demonstrating aggressive tendencies towards DPCS Personnel or other dogs which were not demonstrated during the initial inspection, the Client understands and accepts that their dog will be placed in isolation or transferred to a dog boarding kennel at an additional cost to the Client until the Clients return or the Client makes arrangements for their dog to be removed from the Premises. In the event of a dog’s removal, transfer, or isolation as a result of aggressive behaviour, the Client will not be entitled to any refund of any monies paid and the Client will be responsible for all additional costs and fees incurred.
- The Client agrees that if in extreme cases a dog is found to be destructive, aggressive, agitated, stressed, completely unmanageable on the premises or highly anti-social, DPCS may refuse to board your dog for the remainder of the stay. DPCS will have no option but to contact the Client or the Client’s emergency contact to provide alternative care or else isolation of arrangements to have the dog kenneled will be made at the Client's sole cost.
- DPCS expects complete honesty regarding your dog’s behaviour and needs as this is vital to the safety of your dog, other dogs, and DPCS Personnel. If a Client or DPCS Personnel is worried about how a dog will behave or settle in for a full boarding, a trial stay will be recommended for a minimum of two days or one overnight at the standard rate.
- DPCS will care for a Clients dog as a Client would, and while every effort is made to ensure that your dog is cared for to our usual high standards, we cannot be liable for loss, injury, or death either inside or outside of the Premises while in the care of DPCS and while participating in the Services provided by DPCS.
- If the Client collects their dog before the confirmed end date of the board, the Client will not receive a refund for the unused boarding days.
- The Client agrees that if after 2 weeks following the Client’s stated return/pickup date, the Client or emergency contact has not returned to pick up the dog and every attempt has been made to contact the Client or their emergency contact without success, the dog will be put up for re-homing.
- In the event that a Client knows that they will not be able to pick up their dog at their scheduled pickup date or time, they must notify DPCS within at least 24 hours or else additional late fees will apply.
Release of Liability, Indemnity, Waiver & Assumption of Risk
By participating in one or multiple Services provided by DPCS, I/We hereby acknowledge that I/We have voluntarily applied to participate in the Services with DPCS. In order to participate in Services provided by DPCS Personnel, I/we hereby agrees/agree and acknowledges/acknowledge to the following:
- To assume all risks of such dog boarding, including any injury that may be caused to the Client’s dog by any other dog, person or DPCS Personnel and any injury that may be caused to DPCS Personnel, other people, or any other dog by the Client or Client’s dog, or to any to any other animal or object;
- To affirm that I/We are aware that there are inherent risks and hazards involved in activities with and around dogs. I/We am/are participating in the Services with knowledge of any potential risks. I/We voluntarily agree to assume the full risk of and responsibility for any injuries, damages, loss, liability, costs, and expenses regardless of severity, extent or amount that my dog, any other person accompanying my dog, other dogs or animals, other people, and property might sustain or incur as a result of their presence in these areas or my/our dog participating in any and all activities connected with these areas, or the Services provided by DPCS. These risks also include but are not limited to risks associated with picking up and dropping off my/our dog, travelling to and from home in a vehicle, and having my/our dog around other dogs, people, wildlife, and outdoor environments;
- To be fully responsible for the actions of my/our dog if it causes any damage whatsoever, including but not limited to death, damage, or injury to itself, other animals, pets, people and property while in the care of DPCS;
- To confirm that I have not witnessed or am aware that my dog displays any aggressive or undisciplined behaviours or tendencies towards other people or animals, or if so, have listed them in my/our client intake form.
- To have provided all necessary information to DPCS and based on my/our consultation have deemed that my/our dog is suitable to be in the care of DPCS;
- To positively confirm that the dog is obedient and disciplined and is capable of following commands, is well-behaved, and has a reliable recall even when in distracting environments;
- To immediately advise DPCS of any issues or problems that arise with my dog that have or could affect their suitability for boarding;
- To authorize DPCS to provide any emergency treatment, at my/our costs, while my/our dog(s) is/are in the care and custody of DPCS, if I/We am/are unreachable in the event of an emergency or if in the sole discretion of DPCS, it appears that my/our dog is ill, injured, or exhibits any other behaviour that would reasonably suggest that my/our dog might need medical treatment, I/We hereby authorize DPCS and DPCS Personnel to seek immediate veterinary care for my/our dog. I/We agree to be financially responsible for any and all costs in connection with, veterinary, medical or other treatment as required in the opinion of the veterinarian and to fully reimburse DPCS such costs immediately upon providing costs. I/We agree that I/We/are assuming all risks of the consequences associated with any decisions made by DPCS relating to the medical care and transportation of my/our dog. Medical treatment may require transportation of my/our dog to receive care and I/We hereby authorize such transportation;
- To release DPCS, DPCS Personnel and any other people providing Services on behalf of DPCS from any and all claims that the Client or the Client’s permitted assigns may have that may arise from the Services, including those relating to personal injury to the Client, Client’s dogs, Client’s family or any other people;
- To ensure Client’s dog is in adequate health condition to participate in Services, is up to date on all necessary vaccinations, and I/We will keep health records on me/us at all times during participation in Services. I/We understand that regular vaccinations cannot completely guard against illness and disease and that DPCS cannot prevent, nor be responsible for any illness my/our dog might contract. DPCS shall not be liable for any illness or ailment that a dog might incur while in the presence of other dogs, animals, or people while in DPCS’s care;
- To acknowledge that DPCS reserves the right to refuse to provide Services to a Client or their dog at its own discretion;
- To acknowledge that I/We, the Client, am the legal owner of the named dog(s) and am aware that participation in any Services may result in illness, accident, injury, or death to DPCS Personnel, my/our dog, or other people or dogs participating in Services. I/We agree that I/We/are aware of these risks and dangers and assume all responsibility for them;
- To remain responsible for my/our dog(s) at all times;
- To acknowledge that due to the way that dogs interact with one another, minor cuts and scratches can occur even though the dogs are carefully supervised at all times.
- To maintain adequate pet or household insurance coverage for liability in the unlikely event of damage or injury caused to my/our dog(s) or caused by my/our dog(s) to property or to a third party;
- To not hold DPCS liable for any financial loss, loss of profit, or loss of opportunity as a result of participation in the Services provided by DPCS; and
- To allow DPCS to use my/our name, my/our dog's name and any photographs, sound and film recordings taken while receiving the Services of DPCS.
DPCS reserves the right to update these Terms and Conditions, Release of Liability, Indemnity, Waiver and Assumption of Risk at any time by notice and with immediate effect. Should DPCS waive any of these terms on an individual basis, the validity of the remaining clauses shall not be affected and DPCS shall not be obligated to waive the same clause or other clauses on any other occasion. Receiving or participating in any of the Services provided by DPCS, shall result in automatic acknowledgment and acceptance of these Terms and Conditions, Release of Liability, Indemnity, Waiver and Assumption of Risk.
I/We hereby waive, release, indemnify, defend, and hold harmless DPCS and DPCS Personnel and any other people providing Services on behalf of DPCS from all damage, loss, liability, claims, expense, threatened loss, actions, demands, suits, assessments or judgments whether arising from negligence, liability or potential liability, or arising out of any claims for damages or any other reason or cause whatsoever, including legal costs and lawyer’s fees, which result from any damage caused directly or indirectly by the Client, Client’s dogs or from other dog(s) participating in the Services and any other related activities provides in relation to said Services including but not limited to exercise, walks, and playing with other dogs or any other Services provided by DPCS. This includes but is not limited to medical attention to people, emergency or veterinary care (including acts of nature, encounters with other animals or people, etc.) or any injury caused by my/our dog towards the property, animals, and people while in the care of DPCS. Any costs associated with the above actions will be wholly reimbursed to DPCS immediately upon request;
I/We certify that I/We have read and understood the provisions set forth herein and that I/We have read and understood these terms and conditions and waiver and release. I/We agree to abide by the rules and regulations and accept all terms, conditions, and statements of this waiver and release and confirm the truthfulness of the contents of the application form completed by me/us. If more than one party has executed this release and waiver then the obligations shall be joint and several.
I/WE HAVE READ AND FULLY UNDERSTAND THE ABOVE IMPORTANT INFORMATION, TERMS AND CONDITIONS, WARNING OF RISK, ASSUMPTION OF RISK AND WAIVER AND RELEASE OF ALL CLAIMS.
