- As a condition of and before my participation in roller skating with the use of a Skate Mate (hereinafter “Roller Skating Activities”), Carousel Family Fun Center is requiring this Rental Agreement, Waiver And Release to be completed, signed and returned. I understand that I may not alter or amend this Rental Agreement, Waiver And Release.
- Only a parent, guardian or adult caretaker of minor children may sign out a Skate Mate unit. (Adult, child and Skate Mate will be tagged with number sequence wristbands at the time of rental.) The rental period is for 2 hours or until the end of the skating session, whichever occurs first.
- Skate Mate units are training tools for beginner skaters under the age of 12. Skate Mate units are not to be used by persons 12 years old or older. Skate Mate units are not toys nor shall they be treated as such. Skate Mate unit wheels must remain on the floor at all times. Users need to maintain control of their respective Skate Mate units and skate in the same direction as other skaters at all times. If a Skate Mate unit is misused, further use of that unit is prohibited, and rental fees paid are nonrefundable.
- Upon return, Skate Mate units must be checked back in with an attendant at the rental counter and must match unit # checked out and listed below. Do not leave a Skate Mate unit unattended. - I acknowledge that Roller Skating Activities are strenuous, fast moving recreational and sports activities. By participating in Roller Skating Activities, I am personally assuming risk of an accident inherent in these activities for myself and those for whom I am responsible (such as minor children in my care). It is the nature of Roller Skating Activities that people may fall down or may run into, collide with or strike other people or objects, such as the floor, walls, barriers or dividers. I understand the risks and hazards inherent in Roller Skating Activities and that Skate Mate units do not prevent these risks and hazards.
- I acknowledge that I and others may suffer bodily injury arising from participating in Roller Skating Activities and that I may be exposed to and infected by COVID-19 or other viral diseases from participating in Roller Skating Activities. I understand that bodily injury and COVID-19 or other viral diseases may result in illness, temporary or permanent disability, economic loss, and medical expenses. I understand that the acts and omissions of myself or others, whether intentional, negligent, grossly negligent or reckless, may cause or contribute to the bodily injury or exposure to or infection by COVID-19 or other viral diseases of myself or others.
- For myself and those for whom I am responsible (such as minor children in my care), I hereby waive and release any claims against Carousel Family Fun Center and its shareholders, directors, officers, employees, agents, associates, staff, and lessors of real property (together the “Releasees”) that may arise from my use of the Skate Mate unit or the use by others of the Skate Mate unit I am renting. I further agree to hold the Releasees harmless from and to indemnify the Releasees against such claims. FOR MYSELF AND THOSE FOR WHOM I AM RESPONSIBLE (SUCH AS MINOR CHILDREN IN MY CARE) TO THE GREATEST EXTENT PERMITTED BY LAW, I RELEASE THE RELEASEES FROM LIABILITY FOR THEIR OWN NEGLIGENCE. By signing below for the Skate Mate unit, I, the parent/guardian/caretaker, fully understand the terms and conditions listed on the Skate Mate Rental Agreement, Waiver and Release and agree to them. I am also aware Skate Mate units are not equipped with brakes and are only to be used for assistance for beginner skaters under the age of 12.
