Camp Participant Agreement
(including assumption of risks and agreements of release and indemnity)
This Agreement must be read and signed by each adult (eighteen years and older), parent, volunteer, or other visitor to Camp For All. Parents, volunteers, and other visitors are sometimes referred to in this agreement as “participants.” The activities and the site on which they are conducted are sometimes referred to as “Camp.” If a participant is a minor, the Agreement must be signed by a parent or legal (court appointed) guardian of that participant. A minor participant is sometimes referred to in this Agreement as “the child,” “my child,” or “the minor.” A parent or guardian signs for himself or herself and, if permitted by law, on behalf of the minor participant. If a participant is an adult (eighteen years and older) and has an intellectual or developmental disability, the Agreement must be signed by a parent, caregiver or legal (court appointed) guardian of that participant. An adult with intellectual or developmental disability is sometimes referred to in this Agreement as “the ward” or “ward.”
In consideration of the services of Camp For All Foundation, I, an adult participant or parent or guardian of a participant, acknowledge and agree as follows:
The Activities: The activities at Camp For All include horseback riding, moving about high and low elements rope courses, swimming, archery, riflery, canoeing, basketball, softball and baseball, and water balloon battles. “Activities” as used in this Agreement also include other individual and group events and simply being on and moving about the premises and using the facilities of Camp For All.
The Risks: The activities at Camp For All will expose participants to certain hazards and risks, which under some circumstances might cause property loss, illness, personal injury and even death. Risks include falls, collisions with fixed objects and other persons, exposure to possibly dangerous plants and animals, the failure of equipment, illness, including the Covid-19 virus and other infectious diseases, and the negligence of other persons, including Camp staff, and other conditions and circumstances associated with active play in an outdoor environment. These and other risks are inherent in Camp For All experience; that is, without them the adventure and value of Camp would be greatly diminished.
Consent and Assumption of Risks: I acknowledge that I am, and/or my child/my ward is, participating voluntarily in the activities of the Camp with an understanding of their risks. I consent to my, and/or the child’s/my ward’s, participation in all activities. I acknowledge and understand that 1) no warranty, express or implied is made by Camp For All as to the Camp activities or the premises on which they are conducted 2) dangerous conditions do exist and 3) for myself and my child or my ward, I accept this document as sufficient warning of such dangerous conditions, hazards, stresses and risks involved in participation. I understand that although Camp For All has taken certain measures to manage the risk of injury to camp participants, they cannot ensure that accidents and injuries will not occur. I assume all of the risks of attending Camp For All, including the activities and the premises on which they are conducted, inherent and otherwise and whether or not they are described above. If I am a parent or guardian, I have discussed the risks, inherent and otherwise, to the participant for whom I sign. I understand, and I have explained to the participant the importance of knowing and abiding by, the rules, regulations, and procedures, which must be followed at Camp For All.
Liability Release and Indemnity
I, an adult participant or a parent or guardian of a participant (as parent or guardian, for myself and, to the extent allowed by law, on behalf of the participant, hereby agree not to sue, and to waive, release and forever discharge, and agree to protect and indemnify (that is, to defend and pay, including insurance deductibles and other costs, including attorney fees), Camp For All Foundation and its respective trustees, officers, directors, employees, and agents (“Released Parties”) with respect to any and all damages, claims, demands, and causes of action of any sort, arising out of, incidental to or in any way related to my, or the participant’s visit to Camp For All, including transportation on site at Camp For All, and including also infection by the Covid-19 virus or other contagious disease, however such loss might have occurred. These agreements of release and indemnity include the negligence of a Released Party but not that party’s gross negligence or intentionally wrongful conduct.
Other Provisions:
Media: I hereby give Camp For All the right to interview, survey and/or to take photographs, audio or audio-visual recordings of me/my child/my ward to be used in promotional, educational, research or fundraising materials including, but not limited to videotapes, pamphlets and brochures. I understand my/my child’s/my ward’s name may be used in connection with these materials. By signing this media release, I intend to legally bind myself, my minor children, my heirs, executors and administrators. Camp For All shall have the right to use photographs or other images of me/my child/my ward in promotion, educational or fund-raising materials. I acknowledge that Camp For All shall have all rights of copyright in and to such photographs and videotapes and may use such copyright fully. I also hereby release Camp For All and its officers, agents and employees from all liability connected with the taking and use of these materials as is authorized by Camp For All. In addition, I waive all rights, interest or claims for payment in connection with any exhibition or release of these materials. This consent is voluntary, and I give it in the interest of public information, education, the furtherance of the goals of these institutions, or other lawful purposes. I acknowledge that I have legal authority to sign this form on behalf of the minor or ward whose name is mentioned below.
Duration of this Agreement: This agreement will apply to all visits of the parent, volunteer or other visitor from this date until 12/31/2025.
