Parental/Guardian Consent, Liability Waiver, and Photo Release
This Consent and Liability Waiver is required for persons under age 18 to participate as a volunteer with American Bird Conservancy (“ABC”) and any other organization participating with ABC in ABC’s SPLASh program activities.
Consent
I, as parent or legal guardian of my son/daughter, do hereby consent to allow him/her to volunteer with ABC and any participating organization in SPLASh program activities
General Liability Waiver
I hereby forever release and waive my and/or my child’s right to bring suit, on my behalf or my child’s, against ABC and/or any participating organization and/or any of their officers, employees, trustees, volunteers, agents, and/or representatives for any liability, claims, demands, and/or causes of action for any loss, damage or injury, including any exposure to or infection with the Covid-19 virus and/or any of its variants, sustained in connection with my child’s participation as an ABC volunteer, except for ABC’s or the participating organization’s acts of gross negligence or deliberate misconduct.
Photo Release
YES ABC may use photographs/videos of myself and/or my child for any of its publications, including web-based publications, without payment or any other consideration. ABC is the exclusive owner of all rights in the photos/videos, including copyrights. ABC may use these photos/videos for any lawful purpose.
NO ABC may not use photographs of myself or my child for any purpose.
Choice of Law
This Waiver is binding on the family, heirs, executors, administrators, successors, and assigns of the participant. The law of the District of Columbia will apply to this Consent, Liability Waiver, and Photo Release, without regard to its choice-of-law provisions.
